The Works consist of (1) Development of road from Katakhali Asrain to Katakhali Mahasasan by HBB under 18 khada Union ,upazila , Sreepur, Dist. Magura.

(2) Development of road from Gouricharanpur Khalaque Master house to Nouapara Hossain ,s house road by BFS under Hajrapur union, Sadar Upazila, Dist. Magura.

(3) Development of road from Sreerampur Purbopara Ayub Chowkider house to Jatish Master house road by BFS under Hajipur union, Sadar Upazila, Dist. Magura.



The Project Manager is K.M.Subbirul Inam. Assistant Engineer, Zila Parishad, Panchagarh.


The Site is located at Magura Sadar.

Possession of the Site to the Contractor shall be given on the following date 4 June 2021



2.Time controll:


Possession of the site to the contractor shall be given within 7(seven) days after signing the contract.



The intended completion Date for the whole of the works shall be Start date + 90 Days.



The Contractor shall submit a Programme for the Works within 10 days of signing the Contract.



3.Quality Controll:



The Defects Liability Period is twelve (12) months




4.Cost Controll:


The following additional events shall also be the compensation Events :If the contract is terminated following the fundamental breach of contract by the contractor, To quantity such compensation the steps mentioned below shall apply:

i) i) A compensation Assessment committee comprising of minimum 03(three) members shall be formed by the procuring Entity/project manager to assess the compensation to complete the remaining works as per latest LGED rate schedule. This Assessed compensation would be the Estimated cost of uncompleted contract, Quantity as per latest LGED rate schedule less the Quoted amount of the same by the Terminated contractor representing in percent(%)w.r.t uncompleted contract Amount of the Terminated contract but in no case it shall be less than minimum10(ten)% of the uncompleted contract Amount.

ii) ii) The Assessed compensation as recommended by the compensation Assessment committee shall be recoverable as instructed in GCC clause 47.

iii) iii) in case of failure to realize such compensation by the contractor, the procuring Entity/ project manager shall take necessary measure to recover the same from any dues remained in his office (such as performance security, Retention Money, Tender security, pending Bill of other contract etc.) Furthermore if the total amount due to the procuring Entity still exceeds any payment due to the contractor, the difference shall be a debt payable to the procuring Entity.

iv) iv) The procuring Entity/ Project Manager shall however proceed to complete the remaining work engaging new contractor.



The maximum amount of Liquidated Damages for the uncompleted Works or any part thereof is 10 percent of the final Contract price of the whole of the Works.


The amount of Liquidated Damages or in other words Delay Damages is 0.05% (zero point zero five percent) of final contract price of the uncompleted works or any part there of it’s per day of delay.



5.Terminition:


The percentage to apply to the contract value of the works not completed, representing the Procuring Entity’s additional cost for completing the uncompleted Works, is 10 percent.



6.Disputes and settlement:



The arbitration shall be conducted in Zila Parishad, Panchagarh or decided  place.
